• Free Tier: Access to generic monthly maintenance checklist only. No access to detailed task instructions, videos, tools recommendations, or personalized schedules.
• Paid Subscriptions: Full access to all features including detailed task guides, curated videos, tool recommendations, personalized schedules, and premium content.

Current pricing and plan details are available on our pricing page. We reserve the right to modify our pricing and plans at any time.

Billing and Payment

For paid subscriptions:

• Subscriptions are billed automatically on a recurring basis (monthly or annually, depending on your plan)
• Payment is due at the beginning of each billing cycle
• All payments are processed securely through Stripe
• You authorize us to charge your payment method for all fees incurred
• You are responsible for all applicable taxes
• Prices are in U.S. Dollars unless otherwise specified

Subscription Renewal and Cancellation

Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You can cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until that date.

Price Changes

We reserve the right to change our subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. We will provide you with at least 30 days' notice before any price change takes effect.

Refund Policy

30-Day Money-Back Guarantee: If you are not satisfied with your paid subscription, you may request a full refund within 30 days of your initial purchase. To request a refund, contact us at team@protectingthenest.com.

Important Note About Free Trials: If you received a free trial period (such as a 30-day free trial) before your paid subscription began, the trial period serves as your evaluation period. After accepting a free trial, the 30-day money-back guarantee does not apply to your subsequent paid subscription, as you have already had the opportunity to evaluate our services during the trial.

After the initial 30-day period (or after a free trial period), subscriptions are non-refundable. However, you may cancel your subscription at any time to prevent future charges.

Refunds will be processed within 7-10 business days and will be credited to your original payment method.

User Conduct and Prohibited Activities

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Services or servers/networks connected to the Services
• Use any automated means (bots, scrapers, etc.) to access the Services without our permission
• Share your account credentials with others or allow others to use your account
• Copy, modify, distribute, or create derivative works of our content without permission
• Remove, obscure, or alter any copyright, trademark, or proprietary rights notices
• Use the Services to transmit viruses, malware, or harmful code

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR $100, WHICHEVER IS GREATER.

Dispute Resolution and Governing Law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles.

Informal Dispute Resolution

Before filing a claim, you agree to contact us at team@protectingthenest.com to attempt to resolve the dispute informally. We will attempt to resolve any disputes through informal negotiation within 30 days.

Arbitration Agreement

If informal resolution fails, you agree that any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

YOU AGREE THAT ANY ARBITRATION OR CLAIM WILL BE LIMITED TO THE DISPUTE BETWEEN YOU AND US INDIVIDUALLY. YOU AGREE THAT THERE WILL BE NO RIGHT OR AUTHORITY FOR ANY CLAIMS TO BE ARBITRATED OR LITIGATED ON A CLASS ACTION, JOINT OR CONSOLIDATED BASIS.

Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
